    Legal Entitlement Under UAE Labour Law

    Federal Decree-Law No. 33 of 2021 on the Regulation of Labour Relations (effective February 2, 2022) guarantees maternity leave rights for all female employees in the UAE private sector.

    Maternity Leave Breakdown (Article 29-30):

    • Total Leave: 60 calendar days (45 days full pay + 15 days half pay)
    • Timing: Can take up to 30 days before expected delivery date
    • Eligibility: Must have worked continuously for at least 1 year
    • Frequency: Entitled once every 24 months
    • Medical Certificate: Must provide proof of pregnancy and expected delivery date

    Additional Rights:

    • Sick Leave Extension: If childbirth causes illness (certified by doctor), additional 45 days unpaid leave
    • Job Protection: Employer cannot terminate during pregnancy or maternity leave
    • Nursing Breaks: After returning to work, entitled to 2 breaks per day (30 minutes each) for nursing for 6 months
    • Return to Same Position: Employer must allow return to same role and salary after leave

    Pay Calculation During Maternity Leave:

    First 45 Days (Full Pay):

    Basic salary + allowances (housing, transport, etc.) at 100%

    Example: AED 15,000/month = AED 22,500 for 45 days

    Next 15 Days (Half Pay):

    Basic salary + allowances at 50%

    Example: AED 15,000/month = AED 3,750 for 15 days

    Total Maternity Pay (60 days): AED 26,250

    Mandatory Health Insurance 2026. Health insurance is mandatory for all UAE residents in Dubai, Abu Dhabi, and other emirates. Dubai Health Authority (DHA) mandates that all Dubai residents must have health insurance coverage. Department of Health Abu Dhabi (DOH) requires all Abu Dhabi residents to have health insurance. Employers are legally required to provide health insurance for employees, while individuals must obtain coverage for themselves and dependents. The minimum required coverage is the Essential Benefits Plan (EBP), which provides basic medical coverage at a lower cost. However, many employers and individuals opt for comprehensive plans that offer broader coverage, higher limits, and access to premium hospitals.

    2026 Maternity Coverage Mandates in Dubai. The Dubai Health Authority (DHA) mandates that all health insurance plans in Dubai must include maternity coverage as of 2026. EBP plans must provide minimum maternity coverage of AED 7,000-10,000 per pregnancy, covering: (1) Prenatal care—6-8 doctor consultations, ultrasound scans, blood tests, (2) Delivery—natural or C-section delivery in network hospitals, (3) Postnatal care—2-3 follow-up visits, and (4) Newborn care—initial health screenings and vaccinations. Comprehensive plans typically offer AED 15,000-50,000+ maternity coverage, including: premium hospital delivery, private room accommodation, extended postnatal care, and coverage for complications. Some comprehensive plans include fertility treatments (IVF, IUI) with annual limits of AED 20,000-50,000. Maternity coverage typically has a waiting period of 6-12 months from policy start date before coverage begins. If you're planning to get pregnant, ensure your insurance policy has been active for the required waiting period. Maternity costs not covered by insurance (exceeding limits, out-of-network providers, or complications) must be paid out-of-pocket.

    For gratuity, any employee who completes at least one year of continuous service earns gratuity on basic salary for the years served — 21 days’ pay per year for the first five years and 30 days per year thereafter. Under Federal Decree-Law 33/2021 (effective 2 February 2022) the old sliding scale that cut gratuity for resignation before five years was abolished, so resigning no longer reduces your entitlement for completed years. For mortgages, DBR caps and LTV limits vary by buyer type (UAE national, GCC, expat) and property value. Property fees include DLD registration, trustee fees, agent commission, and often mortgage registration. Rent vs buy outcomes depend on holding period, appreciation, and opportunity cost. School fee projections use KHDA fee frameworks and typical annual increases; actual costs vary by school and grade.

    Calculation Examples

    Gratuity: If you resign after 3 years with AED 15,000 basic (unlimited contract), you receive 21 days’ basic per year for the first 5 years. Three years × (21/365) × (15,000 × 12) ≈ AED 31,068. After 5 years, the rate becomes 30 days per year. Mortgage: At 50% DBR, a AED 25,000 monthly income with AED 3,000 existing commitments allows roughly AED 9,500 per month for a mortgage, depending on rates and tenure. Property fees: On a AED 2M purchase, 4% DLD transfer fee is AED 80,000; add trustee, agent, and optional mortgage registration per our property-fees calculator.
